These Terms of Service ("Terms") govern your use of Attendance Checkr (the "App") and any related services (collectively, the "Service"). The Service is operated by Inak IT Solutions LLC ("we", "us", or "our").
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of Service
The Service provides attendance tracking and management for organizations, including session and member management, attendance history, and reporting/analytics based on attendance records. The Service may also use on-device camera features and face detection/recognition with liveness checks to help verify attendance.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities under your account
4. Facial Recognition and Biometric Data
If you use face-based verification features, you acknowledge and agree that:
- Facial images and/or derived face templates may be processed to enroll and recognize faces for attendance verification
- You are responsible for ensuring you have all required notices, consents, and lawful permissions for capturing and using biometric/face data
- You will comply with applicable biometric and privacy laws in your jurisdiction
- You may be able to delete enrolled face data through the Service or by contacting support
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Upload malicious code or viruses
- Attempt to gain unauthorized access to our systems
- Use the Service for any unlawful or unauthorized purpose
- Track individuals without their knowledge or consent
6. Paid Features (If Offered)
The Service may offer paid features or plans. If you choose to purchase any paid feature, you agree to the pricing and payment terms presented to you at the time of purchase.
7. Data Ownership and Usage
You retain ownership of all data you submit to the Service. By using the Service, you grant us a license to use, store, and process your data solely for providing and improving the Service.
8. Service Availability
We strive to maintain service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service with or without notice.
9. Intellectual Property
All content, features, and functionality of the Service, including but not limited to software, text, graphics, logos, and images, are owned by Inak IT Solutions LLC or its licensors and are protected by applicable intellectual property laws.
10. Limitation of Liability
To the maximum extent permitted by law, Inak IT Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of (or inability to use) the Service.
11. Indemnification
You agree to indemnify and hold harmless Inak IT Solutions LLC from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Data Security
We implement appropriate technical and organizational measures to protect your data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

14. Termination
We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
